Alex Hawke is deciding whether Novak Djoković will be deported from Australia, and the immigration ministry he heads states that he can do that whenever he wants.
Early this morning, the court made a decision to return Novak's passport and visa and to release him from custody, i.e. the immigration hotel where he was staying.
Shortly afterwards, information emerged that the immigration minister had four hours to reverse the court's decision, but that time had expired. However, a spokesperson for this ministry spoke out, emphasising that Alex Hawke has the right to deport Novak whenever he wants.
- Following today’s Federal Circuit and Family Court determination on a procedural ground, it remains within Immigration Minister Hawke’s discretion to consider cancelling Mr Djokovic’s visa under his personal power of cancellation within section 133C(3) of the Migration Act. The Minister is currently considering the matter and the process remains ongoing - the spokesperson said, "The Age" reports.
